The ATEX directive requires the following major elements to be met in order to apply the ATEX marking:

• The CE mark - The CE mark is a self-declaration marking indicating that your equipment conforms to applicable technical provisions and ATEX requirements and other directives.
• Essential health and safety requirements - Annex II of the ATEX directive, requires that you establish principles of integrated explosion safety from all electrical and non-electrical ignition sources. You can demonstrate compliance to these requirements by following the harmonized European standard series EN 60079.
• EC Type Examination Certificate - For Category 1 (electrical and mechanical) and Category 2 (electrical) equipment, a Notified Body will need to verify that your equipment has met the relevant applicable provisions of the ATEX directive in order to receive an EC Type Examination Certificate. For Category 3 equipment, an EC Type Examination Certificate is not required, however, manufacturers must ensure that your products comply with ATEX by following the appropriate conformity route.
• Quality Assessment - The facility(s) producing your equipment must undergo a Quality Assessment of EN13980 which will result in a Notified Body issuing you a Quality Assurance Notification (QAN).

About the ATEX directive

If you manufacture electrical equipment used in hazardous locations and intend to market your products in the European Union, your equipment must comply with the ATEX directive. Also known as European Directive 94/9/EC, the ATEX directive ensures the free movement of goods throughout the European Union by harmonizing compliance procedures.

In the process of voluntary certification schemes, carried out in UkrSEPRO System defined product parameters according to requirements of normative documents by the applicant. Russia, Kazakhstan and Belorussia formed a Customs Union in July 2010 with the intention to introduce “free movement of goods”. The mandatory “Customs Union Certificate of Conformity with Customs Union Technical Regulations” will be introduced the first of January 2012.If a company posses the “Customs Union Certificate of Conformity with Customs Union Technical Regulations” then they may legally export to Russia, Kazakhstan and Belorussia. In December the Customs Union will produce a final list of product for which the first Customs Union Technical Regulations Certificates can be issued.

The TR Technical Regulations Customs Union Certificate of Conformity is just like the TR Technical Regulations “Certificate of Conformity”, Declaration of Conformity and the Gost R Certificate of Conformity a Certificate of Quality. These Certificates declare that the available documentation is corresponding the legal laws and regulations of Russia. If these Certificates are issued on a company outside the Russian Federation then these documents are used to pass the border and to show that their products are in correspondence with the legal laws and regulations. The procedure of product certification in accordance with the adopted model (scheme) provides generally:

     • filing of the certification authority (CA), authorized Gospotrebstandart Ukraine to work in UkrSEPRO Application (Ukr, Rus, Eng) for certification of products;

     • submission of documentation for the certification accompanying the application according to the list of documents (in Russian, English, Ukrainian);

     • Consideration of a certification body of the application for certification of production and analysis of documentation provided;

     • a decision on the application indicating the scheme (model) certification;

     • For certified products, produced commercially: a survey of production / or certification of production) / or certification (assessment) quality management system;

     • Selection and identification of product samples for certification testing in the test laboratory (center), (IL), accredited by the National Accreditation Agency;

     • certification testing of product samples;

     • Analysis of the results and decide on the possibility of issuing a certificate of compliance;

     • entry in the register of certified products UkrSEPRO System, a certificate of compliance, the conclusion of license agreements (English, Russian) to use the certificate;

As for electric equipment within the group called “means of communications”, the certification procedure has some important specifics. The differences with the certification of the means of communications in Ukraine are stipulated by the laws of Ukraine “On telecommunications” (No. 1280-IV dated 18.11.03) and “On radiofrequency resource of Ukraine” (No. 1770-III dated 01.06.00).

RES permission

The telecommunication means may be certified only by the certification bodies that are authorized to carry out such activity under order of the Transport and Communications Ministry of Ukraine, and radio-electronic means additionally by consent of the National Commission for Communications Regulation of Ukraine (NKRS)).

Prior to filing the certification application for the radio-electronic means, the applicant must apply to the NKRS to confirm their usability in Ukraine and to enter such means into the Register of Radio-Electronic Means and Emitting Devices That May Be Used in the Territory of Ukraine in Public Radiofrequency Broadband”. The certification application then must be endorsed by the NKRS, and only after that it is filed with the certification body.
To obtain a permit for the radio-electronic means, the following documents are to be submitted:

• Copies of certificates of conformity.

STAGE 1 - «CONSULTING» (realization terms: 20-25 working days)

Consulting services on the EU Directives, necessary for the assessment of conformity of products to the requirements of the European Union, a translation of the necessary documentation (Specifications, instructions for use), as well as the determination of the value of the certification by europeon notified body.
The expected outcome is a report, which reflects the EU Directive, the certification scheme, the list of harmonized standards and other documents, on the basis of which products must be evaluated to the requirements of the European Union. 

STAGE 2 - «TESTING» (realization terms: 15-20 working days)

Carrying out tests in the laboratory. This stage involves testing of samples of production declared on certification in the Laboratory (it is possible to provide on the territory of India in the presence of experts of Notified Bodies, or in the laboratory in EU).The expected Result is the receipt of testing protocol.

STAGE 3 - «PREPARATION OF DOCUMENTATION FOR THE AUDIT OF THE ENTERPRISE» (realization terms: 5 - 7 working days)Involves the collection and filing of the necessary documentation, the list of which is provided to the customer on the first stage and the preparation of the plan of the certification audit.

STEP 4 - «AUDIT IN THE WORKPLACE» (realization terms: 10 - 14 working days)

Audit in the workplace. Experts of Notified Bodies and two representatives of the DCS  visit the enterprise.
STEP 5 - «CERTIFICATION» (realization terms: 25 - 30 working days)

Notified Body issues a certificate. The expected Result is receiving the CE Certificate. 

STEP 6 - «SUPERVISORY AUDITS»
Supervisory audit of the production of the manufacturer, according to the schedule of the audit supervisors.

     When certification of a consignment of goods (or a single product), entered the territory of Ukraine for a specific invoice, the certificate is issued for a specific and stated products specified in the invoice. In this case, the certificate shall state the size of the lot, if available - the serial numbers of certified products, invoice number, HS code, name and address of the applicant and the manufacturer''''s products. Validity of the certificate, usually 6 months, maximum - up to one year.

     With certification of products manufactured in series, in UkrSEPRO System may use different models (schemes) certification.

     Depending on the model (scheme) certification, valid certificate of conformity for products manufactured in series, is as follows:

When certification of a consignment of goods (or a single product) the certificate is issued on the specific allegations of the product. In this case, the certificate shall state the serial numbers of certified hardware. 
     In the certification of products manufactured in series, certification test carried out with the production of the commission OS (testing or certification of production, or certification (assessment) system of production quality). For some products may use the model to the analysis of certification documentation provided by the applicant (including those with launch of new products) and without the survey of production, but in this case, you must provide additional documentation, which characterizes the system of production quality (the list is set separately for specific products). 

     Certification of serial production without inspection of production (based on an analysis of the submitted documentation) 
     Certificate of conformity is issued for up to 1 year 

     Certificate for the products when using this scheme is valid up to one year and issued on the basis of positive results of the analysis of documentation provided by the applicant and the positive results of certification tests of samples of products, selected the company a manufacturer or supplier. 
     This scheme is applicable only for enterprises (companies) that have certified quality management system (ISO 9000). In this case, the company must provide additional documentation on the quality management system (procedures, instructions on the organization of the input control of materials, raw materials and components, the output control of finished products, as well as the test finished products), volume and requirements to be met by existing regulations in Ukraine .
