Exemption letter confirms that exported or sold products are not a subject to mandatory GOST R certification in Russia. 

There are two kinds of Exemption Letters:

·  Refusal Explanation Letters - the main aim of that document it to prove customs that product doesn''''t need obligatory certificate.

·  Information Letters (References) - it proves receivers intermediary companies that your product do not need the GOST certificate.
The procedure of issuing an Exemption Letter usually takes about 5-7 working days.

First, the documentation ( for the example: technical descriptions of the products, conditions of delivery to Russia) is being reviewed. Then, the technical documentation of the product is being identified according to the russian classification system. On a base of the result of that elaboration_, experts establish if the product is a subject to obligatory certification or exemption letter is enough.

Following documents are requred to prepare an Exemption Letter:

1.     The full name of the company with address info

2.     The exact name of the product including names of models and types

3.     The technical documentation or operating documentation with descriptions

4.     The customs tariff code

5.     The contract and the enclosure with all technical descriptions.

Pattern Approval (Metrology Certificate) of measuring instruments states that the state guaranties, that this particular piece of measuring equipment can take measurements within a specific margin of error.

The Pattern Approval (Metrology Certificate) of measuring instruments has to be issued before we can issue a Export Certificate.
This concerns the following export certificates:

• Declaration of Conformity
• TR Technical Regulations “Certificate of Conformity”

Exemption Letter for products is an official document issued by an accredited authority and informing that the particular product is not subject to certification and declaring. There are two types of Exemption Letters: Exemption Letters for sale and Explanatory Letters for customs clearance.

Exemption letter for sale shall be issued if the particular product is not subject to certification and declaring. Usually, this document is submitted to the supervisory bodies as an explanatory note and to the buyers.

Exemption letter for customs offices shall be sent to the applicant’s address (director of the company requesting the letter). Such letters shall be issued by the certification bodies accredited by the Federal Technical Regulation and Metrology Agency.

The RTN Rostekhnadzor Permit to Use (former GGTN) can be compared with the Nuisance Act permit. With one of the Export certificates a company can export to Russia, but the initial operation has to wait until the RTN Rostekhnadzor Permit to Use is issued.

The RTN Rostekhnadzor Permit to Use is required for potentially dangerous technologies or material. The RTN Rostekhnadzor Permit to Use can only be issued by the Federal Service for Technological, Environmental and Nuclear Supervision in Moscow.

The RTN Rostekhnadzor Permit to Use is always the last certificate issued. First, if required, the supporting certificates of the export certificates need to be issued:

• Fire safety certificate
• State Registration/ Hygienic Report
• Pattern Approval/ Metrology Certificate

If the first route is finished then one or more of the export certificates need to be issued:

• Gost R Certificate of Conformity
• Declaration of Conformity
• TR Technical Regulations “Certificate of Conformity”
• TR Technical Regulations Customs Union certificate of conformity
• Gost R Ex Proof Certificate of Conformity

10. Test reports from independent foreign laboratories (not Russian laboratory)

RF Government Resolution dated December 1, 2009 N 982 came into force on 15^th February. The Resolution specifies a new list of products subject to mandatory certification and products subject to conformity assurance by making a declaration of conformity. The list of products is posted on the web site of the Federal Agency on Technical Regulating and Metrology.

An updated list of products subject to mandatory conformity assurance when placed under customs procedures is also posted on the Agency web site. The list specifies Foreign Economic Activity Commodity Nomenclature Codes.

GUIDELINES FOR DRAWING UP A DECLARATION OF CONFORMITY

Pursuant to the Federal Law «On technical regulating», any undertaking (a legal entity or an individual entrepreneur) registered in the Russian Federation under the legislation of the Russian Federation has the right to make a declaration of conformity.

The declaration of conformity may be made by: 

•  The manufacturer (a person acting as a manufacturer) - for commercially available products, or for a batch of products, or a one-of-a-kind item;
•  The seller - for a batch of products or a one-of-a-kind item.

A company that makes a declaration must be a manufacturer (seller, supplier) of the declared products or it must exercise functions of a foreign manufacturer by virtue of an agreement with it insofar as the conformity of the products supplied and the responsibility for non-conformity of the products supplied to technical requirements are concerned.

It means that a foreign manufacturer is not allowed to self-declare conformity; the declaration can be made by a company selling these products (for a batch) or a person acting as a foreign manufacturer (for commercially available products).

When the declaration is drawn up, it must be registered. The Declaration of conformity is registered by an accredited certification body. An applicant sends a completed declaration and necessary documents to a company of its choice, whose accreditation scope covers these products.

The Declaration is registered upon a request for registration submitted by the applicant. An application form is prescribed by the document headlined «GOST-R Certification System. Forms of the key Documents Used within the System».  

DECLARATION OF CONFORMITY PROCEDURES:
The declaration of conformity is made  on the basis of one of the procedures mentioned below: 

•  Declaration of conformity made on the basis  of the OWN evidence of conformity ;
•  Declaration of conformity made on the basis  of the own evidence of conformity and evidence obtained with the help of the THIRD PARTIES -- a certification body  or a testing Laboratory.

Russian Federation is an accredited product certification body in the GAZPROMSERT system – a certificate of recognition of the competence of the body for certification.

Verification of conformity of products to the GAZPROMSERT system takes the form of voluntary certification.

For certification in the GAZPROMSERT system the product performance is verified and test measurement methods are used that enable to:

• Identify the product (its belonging to a particular group, origin, etc.);

• Verify the conformity of the products to requirements, established by the standards of the GAZPROMSERT system, as well as other requirements under normal operating conditions in the gas industry, storage, transportation and disposal, which must be tested during certification.

Certification of products in the GAZPROMSERT system includes the following steps:

• Application to certify a product;

• A decision on the application;

• Selection and identification of test pieces (samples) and testing;

• Analysis of the production status;

The certificate of the Custom Union (TR TS Certificate) allows the distribution of goods within the Customs Union without restriction. The negotiated accepted standards of the Certificate enable a streamlined process to take place. These certificates are valid within the Custom Union countries which are Belarus, Kazakhstan and Russia. They have general rules for the minimum product quality, required documents, and are in full force within the territory of any of these three countries. The Custom Union certificate of conformity is executed in accordance to the established common list of goods. It contains the requirements that must be followed clearly.

So, if the product is on this list, its quality must be confirmed. Currently, if a product is included on the Uniform list, it must be labeled with a mark by the manufacturer. This is a mark that is common to the Customs Union. What is the benefit of a Customs Union Certificate?

Without a doubt the streamlining of required documents to market products within the Customs Union is a distinct advantage. However, without proof of a standard quality, these products automatically pass into lower price categories and may lose an opportunity of premium brand development. The purpose of the Custom Union was to create a consistency in quality so as to reduce the circulation of defective goods.

NEW LEGISLATION Russia’s internal regulations and certification systems are gradually replaced by the technical regulations of the Customs Union (CU TR). New Regulations are tightening the requirements for product quality and system of control. Now with certification of imported products to the territory of the CU the applicant can only be a resident of the custom union countries.

The Customs Union made 24 new technical regulations, 7 of them will come into force in 2012.

15 projects of technical regulations are in the process of internal coordination and seven completed a public discussion. “The work being done on the development of technical regulations – it is a progressive way.

Deputy Foreign Minister Alexander Guryanov said that “the introduction of the single currency in the Customs Union is possible provided a deeper integration of its member countries.”

According to the deputy minister, is a question of medium-or long-term perspective, when the country’s vehicle will move to a deeper level of integration.

In November, Moldova could be held the referendum on accession of Moldova to the Customs Union. With this initiative was the Social Democratic Party of the Republic.

Prior to that, the idea of joining the Customs Union of Moldova was supported by the party “Patriots of Moldova”, after the accession encouraged other community organizations

Kazakhstan intends to join the Customs Union. The Eurasian Economic Commission for Europe (ECE) has recently started to consider the application of Kazakhstan to join the Customs Union. For information about this published 29th of February by Russian Internet media, referring to the Minister of Trade of the Eurasian Economic Commission for Andrei Slepnev.

Russia, Kazakhstan and Belorussia decided to change the Import Tariffs to an uniform system because of the Customs Union between the three countries.

The Hygienic Report and the State Registration are applied for food products, preservatives, materials and goods made out of them that come into contact with food products, perfumery and cosmetic products, textile, sewing and jersey materials containing chemical fibers, certain items of machine-building industry and a number of other industrial goods.

Hygienic Report and the State Registration are documents issued in evidence of a permit given by bodies and institutions under the Department of Sanitary and Epidemiological Control in the RF Health Ministry for production or import of goods consistent with statutory requirements. The Hygienic Report and the State Registration are an official conformation that products are safe for human health provided certain conditions are met.

Hygienic reports and the State Registration are issued by bodies of the state sanitary and epidemiological service of the Russian Federation upon consultation of normative documents, launch of new products or conclusion of contracts to purchase products abroad. A reason to support issuance of a hygienic report and a State Registration are provided by results of hygienic assessment of products and examination of appropriate normative acts, their production and use. Such reason for imported products rests on evaluation of a Safety Certificate provided by an importer-country and results obtaining during tests of products performed in Russia.

The Hygienic Certificate and the State Registration need to be issued before an Export Certificate is issued.

Validity periods of the Hygienic Certificate/ State Registration
The Hygienic Report has a validity period of five years and is issued by the bodies and institutions under the Department of Sanitary and Epidemiological Control in the RF Health Ministry for production or import of goods consistent with statutory requirements. The State Registration however is valid for a lifetime. This State Registration process is therefore a very hard procedure.

Certificates and Declarations of Conformity to GOST R (Russian National Standard) and Customs Union Technical Regulations;

The Republic of Belarus, Republic of Kazakhstan and Russian Federation within the framework of the Eurasian Economic Community established the Customs Union, providing a single customs territory for these three countries.

This document replaces previously issued mandatory certificates for the products (under Russian Technical Regulations and System of GOST R (Russian National Standard)). The Customs Union Commission resolved that the Certificates of Conformity and Declarations of Conformity issued for the products prior to the effective date of the currently applicable Customs Union Technical Regulations shall be valid till March 15, 2015. The document can be issued for single shipment and for serial production for 5 years.

The Fire Safety certification includes: industrial, construction and business products including these imported into Russia (substances and materials, building structures, fire protection equipment, electronic and electro technical goods, their components and equioment, etc.), fire service (fire protection of buildings; fire extinguisher repair and recharging; erection, setting up, maintenance of fire protection systems etc.) Current normative documents determine fire safety requirements, testing and control methods of the product subjected to mandatory fire safety certification.

This certification is carried out to prove thet product or service meets the fire safety requirements. Requirements according fire safety are determined by federal law of the Russian Federation and by technical regulation of the Russian government.

Foreign producers who want to receive fire safety certificate have to deliver the following documents:

· Registration certificate, tax office registration of the applicant

· Technical description and characteristics of the products

· Fire safety parameters tests results protocols (if available)

· Samples.

Technical devices, including foreign-manufactured, used in hazardous production facilities should be certified to prove their conformity to the industrial safety requirements set by the Russian Federation Law. A certification body (accredited within the GOST R system)  decides whether to issue a certificate or refuse  to issue a certificate on the basis of test reports, expert examination of technical documentation, applicant`s details.

All explosion proof electrical equipment is subject to mandatory certification within the GOST R certification system, because it falls within the category of dangerous equipment. Examples of the explosion proof equipment: power generation equipment, power distribution equipment, power transmission equipment, power  measuring equipment, power control equipment, power conversion equipment, power storage and consuming equipment, telecommunications equipment, devices to be used in hazardous areas, etc.

Ex-equipment, including Ex-components of the equipment listed in the "Nomenclature of Products (works) and services requiring mandatory certification under the laws of the Russian Federation", is subject to certification.

TR Technical Regulations “Certificate of Conformity” is just like the Declaration of Conformity and the Gost R Certificate of Conformity a Certificate of Quality. These Certificates declare that the available documentation is corresponding the legal laws and regulations of Russia. If these Certificates are issued on a company outside the Russian Federation then these documents are used to pass the border and to show that their products are in correspondence with the legal laws and regulations. Companies inside the Russian Federation also have Certificates just to show that their products are in correspondence with the legal laws and regulations. A company may bare the mark of conformity if this company posses this Certification. On the right side you will find the mark of conformity of the Gost R Certificate of Conformity.

The Ministry of Health of Russia is obliged to control and give permission for these products: bottled water, some children foods, some food additives, dietetic foods, genetically modified foods, medicines, medical equipment and instruments, some other hygienic elements and cosmetics. In reality, the most common situation is to obtain permission and GOST Certificate for medical equipment. In Russia, Medical Equipment and Instruments cannot be imported, sold, and used for patients without GOST R Certificate and Medical Approval by Ministry Of Health of the Russia. ndustrial Safety Expert Conclusions and Explanatory Letters of Russian Federal Service for Ecological, Technical and Atomic Supervision (Rostekhnadzor);

Industrial Safety Expert Conclusion shall be held by an expert organization to assess whether the actual state of the industrial facility (equipment) complies with the federal safety requirements of the Russian Federation. Purpose and result of the Industrial Safety Expert Review shall be obtaining of expert organization conclusion containing well-founded conclusions on compliance or non-compliance of the hazardous industrial facility with the requirements and regulations for industrial safety as adopted by the Russian Federal Service for Ecological, Technical and Atomic Supervision.

The Expert Review shall be held for the following hazardous industrial facilities:

• Chemically hazardous, inflammable and explosive facilities and special chemicals facilities;
• Oil and gas industry;
• Coal-tar industry and metallurgy;
• Ore mining and non-metal mining ;
• Coal industry;
• Transportation of dangerous substances;
• Equipment operating under excessive pressure;
• Gas consumption and distribution systems;
• Lifting facilities;
• Storage and processing of vegetable raw materials

Like GOST R / CTR certificates, the DoC could be a “one-time shipment” type, i.e. related to a specific batch of goods to be supplied under a particular contract / invoice, or a “serial production” type with 1 to 5-year validity terms. The main difference between a GOST R and a CTR Certificate / DoC is that the latter could be issued to a legal entity registered in Customs Union only. So in case of exporting goods to Russia under a contract, a DoC may be issued in the name of your Russian customer only.

The Declaration of Conformity has almost the same function as GOST R / CTR certificate. It states that the goods listed in it indeed conform to GOST R/ TR CU requirements. A DoC is to be prepared by the Applicant, but should be approved by an accredited certification body, with reference to test report(s) performed by an accredited testing laboratory.

Nowadays the GOST R certification system is undergoing significant changes. The idea behind is to collapse the hundreds of GOST standards, which, dating back to the Soviet Union, still serve as reference documents in GOST R certification system, to a small number of the so-called Technical Regulations (TR). Each TR encompasses a wide array of goods. Certificates of Conformity to TR will be issued for all the products covered by TRs (an equivalent of the EU Directives) to replace GOST R certification. A Certificate of Conformity is a document that certifies that a product meets all the regulatory requirements and can circulate without restriction anywhere within the Customs Union. The requirements to be complied with are set out in the TR.

The rules for the issuance of CTR certificates are not much different from those of GOST R. The major changes are that type CTR certificates may be valid for up to 5 years unlike the 3-year period for a GOST R certificate, and that test reports are now required for issuance of all types of CTR certificates.

In addition, the Declaration and the Certificate of Conformity are now uniform, and the goods must bear special marking – a uniform Conformity Mark (an equivalent of CE). The products not listed in the TR are not subject to obligatory certification.

The Certificates are valid throughout the entire area of the Customs Union (Belarus, Kazakhstan, and Russia). Common rules and regulations apply to product safety and quality of all goods subject to obtaining the required certificates that are in effect throughout the Customs Union. Expert Conclusion and State Registration Certificate;

According to the Law "On Consumers’ Rights", these documents are required for the goods for public health care.

The product groups subject to obtaining of State Registration Certificates is a mandatory requirement:

- Foodstuff and beverages;

- Perfume and cosmetics, goods for personal hygiene ;

- Clothing, bedding, towels and other products used in contact with the human body;

- Products of machine-building industry and equipment for food production ;

- Packaging for food industry;

- Materials made of faux wood and used for furniture production;

Exemption Letters for sale and customs;

Exemption Letter for products is an official document issued by an accredited authority and informing that the particular product is not subject to certification and declaring. There are two types of Exemption Letters: Exemption Letters for sale and Explanatory Letters for customs clearance.

Exemption letter for sale shall be issued if the particular product is not subject to certification and declaring. Usually, this document is submitted to the supervisory bodies as an explanatory note and to the buyers.

Exemption letter for customs offices shall be sent to the applicant’s address (director of the company requesting the letter). Such letters shall be issued by the certification bodies accredited by the Federal Technical Regulation and Metrology Agency.
